ARE FLORIDA WORKERS COMPENSATION LAWS DIFFERENT FROM LHWCA? CAN I BE COVERED BY BOTH?

Video Transcription:

The Florida Workers' Compensation Act is different than the Longshore Act. The Florida Worker's Comp Act is a State Statute while the Longshore Act is a Federal Statute. In the state of Florida, you cannot be covered by both. It is not a concurrent jurisdiction. In most cases, if you can be covered under the Longshore Act, I would suggest to do so because those benefits are typically better than the benefits provided under the Florida Workers' Compensation Act.
